1. Identifying information of the owner

In compliance with article 10 of Law 34/2002 on information society services and electronic commerce (LSSI-CE), the following identifying information is provided about the owner of the FixrOS platform, of the websites fixros.com, dashboard.fixros.com, siniestros.fixros.com, proveedor.fixros.com and marketplace.fixros.com, and of the FixrOS mobile application for iOS and Android:

2. Purpose

FixrOS is a SaaS platform for the comprehensive management of homeowners' associations and the processing of insurance claims, aimed at property managers, communities, insurers, brokers, loss adjusters, service providers and the neighbours and residents of the communities. It comprises the corporate website fixros.com, the property managers' dashboard, the Claims Portal, the Provider Portal, the Marketplace and the mobile application for iOS and Android (together, "the Platform").

Access to and use of the Platform implies acceptance of this Legal Notice, of the Terms and Conditions, of the Privacy Policy and of the Cookie Policy. The public area is freely accessible; private areas require registration and, where applicable, the contracting of the service.

3. Conditions of access and use

The user undertakes to make diligent and lawful use of the Platform, in accordance with the law, good faith and public order, refraining in particular from:

• Using the Platform for fraudulent or unlawful purposes or to harm the rights of third parties.
• Introducing defamatory, slanderous, obscene content or content that infringes intellectual or industrial property rights.
• Introducing viruses or any malicious code that damages FixrOS's systems or those of third parties.
• Performing reverse engineering, mass scraping or attempting to circumvent the security measures or the isolation between accounts and communities.
• Impersonating other users or using credentials belonging to others.

Failure to comply with these obligations entitles FixrOS to suspend or cancel the account.

4. Intellectual and industrial property

All trademarks, trade names, logos, designs, interfaces, source code, databases, documentation and other content and elements of the Platform are the property of FixrOS, S.L. and are protected by Spanish and EU regulations on intellectual and industrial property. Their reproduction, distribution, public communication, transformation or any other form of exploitation without the prior written authorisation of FixrOS, S.L. is prohibited. Access to the Platform does not grant the user any right over those elements.

The content generated by users (incidents, documents, communications, photographs, minutes, ratings, etc.) remains the property of whoever provides it; FixrOS processes it solely as the service provider and, where applicable, as a data processor. Content published by third parties in the Marketplace is the responsibility of whoever provides it.

5. Third-party links and services

The Platform may contain links to or integrate third-party services (payment gateways, messaging, maps, insurers, public registries, etc.). FixrOS does not control and assumes no responsibility for the content, practices or availability of such third parties; the inclusion of a link does not imply recommendation or association.

6. Exclusion and limitation of liability

FixrOS makes reasonable efforts to guarantee the availability and accuracy of the Platform, but does not guarantee the absence of errors or interruptions. In particular, FixrOS is not liable for interruptions arising from external providers or force majeure, for damage caused by the improper use of third parties, for the decisions that users make on the basis of the information on the Platform, or for the content introduced by users. In the Marketplace, FixrOS acts as a technological intermediary and is not a party to the service contract between provider and customer. FixrOS is liable, in any event, in accordance with the limits established by law and those agreed in the Terms and Conditions.

7. Availability and modifications to the service

FixrOS may modify, suspend or interrupt, in whole or in part, access to the Platform, especially for maintenance tasks, and may add or remove features. It may also update this Legal Notice and the other legal documents; the version in force will always be the one published on fixros.com.

8. Commercial communications

FixrOS will only send commercial communications by electronic means where there is a prior contractual relationship and they relate to services similar to those contracted (art. 21.2 LSSI-CE), or where the recipient has given express consent. The user may object at any time by writing to privacidad@fixros.com or via the unsubscribe link included in each communication.

9. Accessibility

FixrOS, S.L. qualifies as a micro-enterprise and, as such, is exempt from the technical accessibility requirements of Law 11/2023 and of Directive (EU) 2019/882. Nevertheless, it adheres to the principle of non-discrimination and the duty to adopt reasonable accommodations at the request of persons with disabilities (RDL 1/2013), and applies principles of inclusive design. 10. Digital services (DSA)

For the purposes of Regulation (EU) 2022/2065 (Digital Services Act), the single point of contact of FixrOS, S.L. for authorities and for the recipients of the service is legal@fixros.com. Information on content moderation and the notification of illegal content is set out in the Terms and Conditions.

11. Data protection

The processing of the personal data collected through the Platform is governed by the Privacy Policy, in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD). The list of data processors that FixrOS uses to provide the Service is made available to professional Clients upon request, in accordance with art. 28 GDPR.

12. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. Any dispute will be submitted to the Courts and Tribunals of the city of Madrid, unless consumer regulations impose a different jurisdiction (the consumer's place of residence).
