What the law says: Article 18 LAU
For housing, rent can only be reviewed on each anniversary of the lease and on the agreed terms. If the lease says nothing, there is no review. If the lease provides for a review but names no index, the annual change in the IRAV applies. In any case, the increase cannot exceed the change in the IRAV, using the latest index published at the review date (Article 18.1 LAU, as worded by Royal Decree-law 29/2026).
02
CPI versus IRAV
CPI measures the general change in consumer prices. The IRAV (reference index for the annual review of housing leases) was created by the eleventh additional provision of the LAU, added by Housing Act 12/2023, to prevent disproportionate increases. According to the INE, it is the lowest of the annual CPI rate, the core CPI rate and an adjusted average rate; it has been published monthly since January 2025, on the same dates as CPI. See the latest figure and history on our IRAV page.

Leases signed before Act 12/2023
The fourth transitional provision of Act 12/2023, as worded by Royal Decree-law 29/2026, provides that housing leases signed before that Act came into force (26 May 2023) are also reviewed subject to the cap in the eleventh additional provision and Article 18.1 LAU. In all other respects, they keep the rules in force when they were signed.
04
The extraordinary cap until 31 December 2027
The sixth final provision of Royal Decree-law 29/2026, in force since 8 October 2026, caps reviews of housing leases whose anniversary falls between that date and 31 December 2027:
- If the rent exceeds the maximum resulting from the state rental price reference index system, no increase is allowed.
- Otherwise, the increase is whatever the parties newly agree and, without a new agreement, it cannot exceed 2%.
Royal decree-laws must be ratified by Congress within thirty days of being enacted (Article 86 of the Spanish Constitution). The previous one, Royal Decree-law 26/2026, was not and was repealed. Before confirming a review, check in the Official State Gazette (BOE) whether 29/2026 is still in force.
05
How and when the increase is notified
Under Article 18.2 LAU, the updated rent is payable by the tenant from the month after they are notified in writing, stating the percentage applied and enclosing, if the tenant asks, the INE certificate. A note on the previous month's bill counts as notice.

Commercial units and stressed areas
Non-housing leases (shops, offices) are governed by what the parties agree (Article 4.3 LAU), so they are reviewed according to their clause, usually by CPI. In stressed residential market areas, Article 17.6 also caps the starting rent of new housing leases relative to the previous lease. For a one-off figure, use the rent review calculator.
